1. Acceptance of Terms

By accessing or using ScoutzOS ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Platform.

2. Description of Service

ScoutzOS provides real estate deal intelligence, property management, investor matching, and related services. The Platform includes tools for deal analysis, CRM, communications, and portfolio management.

3. Account Registration

To use the Platform, you must:

  • Be at least 18 years old
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

4. Subscription and Payment

4.1 Subscription Plans

We offer various subscription tiers with different features and pricing. Current pricing is available on our Pricing page.

4.2 Billing

  • Subscriptions are billed in advance on a monthly or annual basis
  • All fees are non-refundable unless otherwise stated
  • We may change pricing with 30 days' notice
  • You authorize us to charge your payment method for recurring fees

4.3 Free Trial

Free trials are available for new users. At the end of the trial, your account will convert to a paid subscription unless cancelled.

5. Acceptable Use

You agree NOT to:

  • Use the Platform for any illegal purpose
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Transmit malware, viruses, or harmful code
  • Attempt to gain unauthorized access to systems
  • Interfere with the Platform's operation
  • Scrape, crawl, or harvest data without permission
  • Impersonate others or provide false information
  • Use the Platform to send spam or unsolicited communications

6. Intellectual Property

6.1 Our Property

The Platform, including its software, design, logos, and content, is owned by ScoutzOS and protected by intellectual property laws. You receive a limited, non-exclusive license to use the Platform as intended.

6.2 Your Content

You retain ownership of data and content you upload. By using the Platform, you grant us a license to use, store, and process your content to provide our services.

7. Third-Party Services

The Platform integrates with third-party services (Zillow, Stripe, Twilio, etc.). Your use of these integrations is subject to their respective terms and privacy policies. We are not responsible for third-party services.

8. Data and Analytics

We provide real estate data, market analytics, and AI-powered insights. While we strive for accuracy:

  • Data is provided "as is" without guarantees
  • AI recommendations are for informational purposes only
  • You should verify information independently
  • We are not responsible for investment decisions based on our data

9. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SCOUTZOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify and hold harmless ScoutzOS, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Platform or violation of these Terms.

12. Termination

We may suspend or terminate your account for violation of these Terms or for any reason with notice. Upon termination:

  • Your access to the Platform will cease
  • You may request export of your data within 30 days
  • We may delete your data after the retention period

13. Dispute Resolution

Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules. The arbitration shall take place in Austin, Texas.

14. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or platform notification. Continued use after changes constitutes acceptance.
